Terms of Service

1. General Provisions

Welcome to Gameboard – an online marketplace connecting board game enthusiasts for buying, selling, and trading second-hand board games. These Terms of Service (hereinafter – Terms) establish the rules and conditions for using our platform. The platform is operated and administered by Gameboard (hereinafter – Platform, We, Us). By registering an account or using our services, you confirm that you accept these Terms in full.

2. Definitions

For the purposes of these Terms, the following definitions apply:

• Platform – the Gameboard website and all related services accessible at gameboard.lt
• User – any individual who registers an account or uses the Platform
• Seller – a User who creates listings to sell or trade board games
• Buyer – a User who purchases or acquires items through the Platform
• Listing – an advertisement created by a Seller offering board games for sale or trade
• Content – any text, images, messages, reviews, or other materials submitted by Users

3. Eligibility and Registration

To use the Platform and its full functionality, you must meet the following requirements:

• Be at least 18 years of age or have reached the age of majority in your jurisdiction
• Have legal capacity to enter into binding agreements
• Provide accurate, truthful, and complete registration information
• Maintain the confidentiality of your account credentials
• Accept full responsibility for all activities conducted under your account
• Notify us immediately upon discovering any unauthorized access to your account

4. Platform Role and Limitations

Gameboard operates exclusively as an intermediary platform that connects Buyers and Sellers. We do not participate directly in transactions between Users. The Platform does not process payments, handle shipping, or take possession of any items. All transactions, including payment arrangements, delivery methods, and item conditions, are agreed upon and executed solely between Users. We do not guarantee the quality, safety, legality, or accuracy of listings. Users are solely responsible for fulfilling their obligations arising from transactions.

5. User Obligations

By using the Platform, you agree to the following obligations:

• Act in good faith and deal honestly with other Users
• Provide accurate and complete information in listings, including item condition, completeness, and any defects
• Respond to inquiries from other Users in a timely and professional manner
• Honor agreements made with other Users regarding purchases and sales
• Resolve disputes with other Users amicably and in accordance with these Terms
• Keep your account information current and accurate
• Report any violations of these Terms to Platform administrators

6. Prohibited Conduct

The following activities are strictly prohibited on the Platform. Violation may result in immediate account suspension or termination:

• Creating false, misleading, or fraudulent listings
• Listing items you do not own or have no right to sell
• Engaging in price manipulation, bid manipulation, or other deceptive practices
• Harassing, threatening, or abusing other Users
• Sending spam, unsolicited commercial messages, or promotional content
• Attempting to circumvent Platform security measures or exploit vulnerabilities
• Creating multiple accounts for fraudulent purposes
• Using automated tools, bots, or scripts to access the Platform without authorization
• Impersonating other Users or Platform representatives

7. Prohibited Items

The following categories of items may not be listed or sold through the Platform:

• Counterfeit, pirated, or unauthorized reproductions of board games
• Stolen goods or items obtained through illegal means
• Items that infringe intellectual property rights of third parties
• Hazardous materials or items posing safety risks
• Items prohibited by applicable laws of the European Union or member states
• Adult-only content not related to board games
• Any items unrelated to board games, card games, or tabletop gaming

8. Listings and Content

When creating listings, Sellers must provide truthful and accurate descriptions including the game title, condition, completeness, language, and any relevant defects or damage. All images must accurately represent the actual item being sold. Sellers retain responsibility for their Content but grant the Platform a non-exclusive, royalty-free license to display, reproduce, and distribute such Content for the purposes of operating the Platform. We reserve the right to remove or modify Content that violates these Terms without prior notice.

9. Transactions Between Users

All transactions are conducted directly between Users without Platform involvement. Users are free to choose any payment method and delivery arrangement they mutually agree upon. The Platform bears no responsibility for payment disputes, non-delivery, item condition disputes, or any other issues arising from transactions. We strongly recommend using secure payment methods and maintaining written records of all transaction agreements. Users should exercise due diligence before completing any transaction.

10. User Communication

The Platform provides messaging functionality to facilitate communication between Users regarding listings and transactions. All communications must remain respectful, professional, and relevant to the Platform's purpose. Users may not use the messaging system to send harassment, threats, spam, or content unrelated to board game transactions. We reserve the right to monitor communications to ensure compliance with these Terms and to maintain Platform safety.

11. Intellectual Property

All Platform content, including but not limited to the website design, logos, graphics, software, and text (excluding User-generated Content), is the property of Gameboard or its licensors and is protected by intellectual property laws. Users may not copy, reproduce, distribute, modify, or create derivative works from Platform content without express written permission. Board game titles, images, and related intellectual property belong to their respective owners and are used on the Platform solely for identification purposes.

12. Limitation of Liability

The Platform is provided on an 'as is' and 'as available' basis without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure. To the maximum extent permitted by applicable law, Gameboard shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, transactions with other Users, or any Content posted on the Platform. Our total liability shall not exceed the amounts, if any, paid by you to the Platform in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Gameboard, its operators, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, your Content, your transactions with other Users, or your violation of any rights of third parties.

14. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason we deem necessary to protect the Platform or its Users. You may terminate your account at any time through your account settings or by contacting us. Upon termination, your right to use the Platform ceases immediately, but provisions of these Terms that by their nature should survive termination shall remain in effect.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be governed by the laws of the Republic of Lithuania and the European Union. For disputes that cannot be resolved amicably, Users who are consumers residing in the EU may use the Online Dispute Resolution platform provided by the European Commission at https://ec.europa.eu/consumers/odr. We encourage Users to first contact us directly at info@gameboard.lt to attempt resolution of any disputes.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to Users through Platform notifications or email. The updated Terms will be effective upon posting, and the 'Last updated' date will be revised accordingly. Your continued use of the Platform following any modifications constitutes acceptance of the revised Terms. If you do not agree with the changes, you must cease using the Platform and terminate your account.
